Terms & Conditions – Africa Capture AI Carpool App

These Terms & Conditions govern the use of the Africa Capture AI Carpool mobile application (“Africa Capture AI”, “Platform”, “App”). By accessing or using the App, you agree to comply with these Terms and with all applicable laws and regulations of the Kingdom of Saudi Arabia.

1. Definitions

• Platform / App: Africa Capture AI Carpool mobile application.
• Authority (TGA): Transport General Authority of Saudi Arabia.
• User: Any registered passenger or driver using the App.
• Driver: A user offering a shared ride through the Platform.
• Passenger: A user requesting to join a ride.
• Trip: A ride executed through the Platform within licensed cities.

2. Nature and Scope of Service

• Africa Capture AI operates as a technology platform enabling carpooling and ride sharing between users.
• Africa Capture AI does not provide commercial transportation, public taxi, or family taxi services.
• Services are limited to licensed cities only. Intercity services require prior approval from the TGA.
• No modification or addition to transport-related services may be made without prior approval from the TGA.

3. Regulatory Compliance

Users agree to:

• Comply with all applicable laws and regulations of Saudi Arabia.
• Adhere to all rules and instructions issued by the Transport General Authority (TGA).
• Maintain continuous integration with TGA-designated electronic systems.
• Provide required driver, vehicle, and trip data to TGA-approved systems.

4. Driver Registration and Obligations

• Drivers must meet all regulatory and eligibility requirements.
• Driver licenses and vehicle operating cards must remain valid.
• Vehicles must be clean and in good internal and external condition.
• Drivers must behave professionally and follow the approved navigation system.
• Drivers must complete required training programs.
• Drivers may not refuse service without a justified reason.
• No fare may be collected if the vehicle breaks down or the driver refuses to complete the trip without cause.

5. Suspension and Termination of Service

Africa Capture AI shall immediately suspend service for:

• Drivers or vehicles with expired licenses or operating cards.
• Drivers who violate TGA regulations or these Terms.

Africa Capture AI reserves the right to suspend or terminate accounts temporarily or permanently based on violations or TGA directives.

6. Carpooling and Ride Sharing

• Multiple passengers are allowed only with explicit consent through the App.
• Trip, driver, and vehicle details are visible throughout the trip.
• Passengers may share live trip data with a trusted contact until trip completion.

7. Fare and Cost Policy

• Trip costs are calculated based on the approved fare policy.
• Charges apply only to completed trips.
• Unauthorized fare collection is strictly prohibited.

8. Ratings and Feedback

• Passengers may rate drivers after trip completion.
• Drivers may rate passengers after trip completion.
• Ratings are used for quality improvement and compliance monitoring.

9. Safety and Emergency Features

• The App provides an emergency button connected to the Ministry of Interior.
• Emergency features remain active after trip completion.
• Emergency tools must be used responsibly and lawfully.

10. Privacy and Data Protection

• Africa Capture AI maintains a Privacy Policy compliant with Saudi laws.
• Personal data is used solely for operational, regulatory, and safety purposes.
• Misuse of passenger or driver data is strictly prohibited.
• Any data breach shall be reported to competent authorities as required.
• Africa Capture AI implements security programs to protect data from viruses, spyware, and unauthorized access.

11. Complaints and Lost Items

• Clear communication channels are provided for complaints.
• A defined process exists for returning lost items.

12. Monitoring and Cooperation with TGA

• Africa Capture AI shall implement monitoring mechanisms for contracted parties.
• The TGA and its authorized inspectors may access records and relevant documents.
• Africa Capture AI shall update the TGA with any changes to contact information.
• Africa Capture AI shall notify the TGA of any changes to its legal entity.
• Africa Capture AI shall respond to TGA requests within 10 business days from the date of notification.

13. Official Communications

All official correspondence, documents, and forms issued by Africa Capture AI shall clearly display:

• Company name
• Nature of activity
• License number
• Licensed city
• Official address and contact details

14. Amendments

Africa Capture AI reserves the right to amend these Terms to comply with laws or TGA instructions. Users will be notified of any material changes.

15. Governing Law

These Terms are governed by the laws of the Kingdom of Saudi Arabia. In case of conflict between these Terms and TGA regulations, TGA regulations shall prevail. Any additional obligations imposed by the TGA shall be binding.

By using the Africa Capture AI application, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
